Advertiser's Agreement
Please read over these terms very carefully as it is a BINDING LEGAL
AGREEMENT between you, the purchaser/advertiser, and us, the Christian
Times Newsletter.
As an advertiser with the Christian Times Newsletter and by placing an
order from our website, you are acknowledging that you have read and
agree to the terms set forth below.
Advertiser's Agreement:
By purchasing an advertising campaign from the Christian Times
Newsletter or one of our reselling partners, you are confirming that
you have read and agree to the following terms of service:
In no way can the Christian Times Newsletter be held liable for the
success or outcome of your advertisements.
The success of your advertising campaign depends solely on you and/or
your offers.
Valid Email addresses are required for delivery of our confirmation
eMails. This will ensure that you receive a copy of your ad when it
runs.
Any client that submits an autoresponder, invalid or zwallet eMail
addresses as their subscription Email address will be permanently
banned from our ezine advertising submissions and your pending ads
will be deleted from the queue.
No refunds on cancelled ads due to bounced, false, zwallet or
autoresponder addresses! No exceptions.
All advertising orders placed and received by Christian Times Newsletter are NON-REFUNDABLE and FINAL. This
is because once your advertisement order is placed, we immediately secured a "run date" for your placement. Once a
"run date" ("availability") has been filled, we may NOT be able to replace that advertising position to which your
order was exclusively assigned. You may however, submit advertisement copy changes (modifications) up to 48 hours prior
to your advertisement's scheduled run.
You understand that the subscriber counts in our groups change on a
daily basis..if you purchase an ad with 70,000 subscribers...by the
time your ad runs it could be 59,000 or 100,000. You understand, that
we have no control over these count changes.
You understand that up to the date and time of distributing your AD placement, your email address MUST remain active in order that you can receive your AD placement from us on the scheduled date of mailing for your records. During this time, you should expect to receive regular subscriber mailings as distributed by Christian Times Newsletter. Once your placement has been successfully distributed, you may request to have your email address removed from any further mailings. Any and all email removal requests will be honored within 72 business hours.
You understand that these subscriber counts change and WILL change and
the Christian Times Newsletter cannot be held liable if this happens.
Due to their nature and high cost value, refunds cannot be issued once
your advertisement has been sent out to the group of your choosing.
This is the reason for our Quality Guarantee.
You understand that we do not tolerate the abuse of our participating
publishers in any way. We ask that you please refrain from this type
of activity.
You understand that we do NOT allow any deceptive content (messages) implied or
otherwise to be included with any advertising campaign. That is, we will
NOT accept any advertisement that makes any attempt to defraud any Internet
Service Provider (ISP) in any way.
The following examples are considered deceptive email practices by our agency
and will NOT be accepted under any condition:
"FR.EE offer"
"$elling made easy!"
"Get r ich quick!"
All advertising must be in standard written form and any attempt to
willfully present deceptive content within these "special character" formats,
will NOT be accepted without exception. Christian Times Newsletter and all
America Web Works' companies adhere and conform to all ISP "whitelist" rules and
regulations to provide maximum email marketing results.
IN NO EVENT WILL THE CHRISTIAN TIMES NEWSLETTER NOR THE SELLING
PUBLISHER BE LIABLE TO YOU FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT
NOT LIMITED TO, COMPENSATORY DAMAGES, LOST PROFITS, LOST DATA OR ANY
FORM OF SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE
DAMAGES OF ANY KIND WHETHER BASED ON BREACH OF CONTRACT OR WARRANTY,
TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF
CHRISTIAN TIMES NEWSLETTER, OR THE SELLING PUBLISHER IS INFORMED IN
ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.
You also understand that all FALSE SPAM accusations filed upon any of
our participating publishers will subject you to a fine of $500 per
hour of downtime that anyone involved in the situation receives. You
will also be required to pay all court costs associated with the
downtime caused by your actions. If you feel that you have been a
victim of spam due to our services, please contact the Christian Times
Newsletter ASAP for a speedy resolution. We are all adults and
resolutions can be made without resorting to such extreme measures.
Any violators of this agreement will have their ad campaign
immediately pulled from our system and will be permanently banned from
future use of our submission services.
You also understand that this is a legally binding agreement between
YOU and the CHRISTIAN TIMES NEWSLETTER.
